Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Logga application, website and related services (collectively, the "Service") provided by Logga ("we", "us", "our"). By registering an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Logga is a digital solution for pilots and aircraft owners to manage flights, maintenance and aircraft documentation in compliance with aviation regulations (including EASA). The Service is intended for use by individuals and flying groups in a General Aviation (GA) context.

1. Description of the Service

The Service includes, but is not limited to:

  • Pilot logbook and aircraft journey log (technical log) recording and storage in formats designed to support compliance with applicable aviation regulations
  • Management of aircraft data, maintenance records, airworthiness documentation, AD/SB tracking and resource monitoring
  • Management of flying groups, memberships and roles (e.g. owner, pilot, mechanic, admin)
  • Export of logbook and technical log data to PDF and other supported formats
  • User accounts, authentication and preference settings (e.g. language, theme)

We may add, change or discontinue features or parts of the Service from time to time. We will use reasonable efforts to notify you of material changes that affect your use of the Service.

2. Eligibility and Account

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent that you meet these requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorised access or use of your account.

You must provide accurate and complete information when registering and keep your account information up to date. We may suspend or terminate accounts that appear to use false or misleading information or that violate these Terms.

3. Your Responsibilities and Compliance

You are solely responsible for:

  • The accuracy, completeness and legality of all data you enter or upload into the Service (including but not limited to flight records, technical log entries, qualifications and aircraft documentation)
  • Ensuring that your use of the Service and the data you maintain in it comply with all applicable laws and regulations, including aviation regulations (e.g. EASA, FIA, national requirements) and data protection laws
  • Obtaining and maintaining any licences, ratings, medical certificates and other qualifications required for the activities you record in the Service
  • Ensuring that you have the right or authority to record and store data relating to any aircraft or flying group (e.g. as owner, operator or authorised member)

Logga is a tool to help you organise and document your flying and aircraft management. We do not provide legal, regulatory or operational advice. You should consult qualified professionals and official sources for decisions regarding airworthiness, licensing or regulatory compliance.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service in any way that violates applicable law or regulation
  • Upload, store or transmit content that is false, misleading, defamatory, infringing, or that you do not have the right to use
  • Attempt to gain unauthorised access to the Service, other users' accounts, or our or our providers' systems or networks
  • Use the Service to distribute malware, spam or other harmful or unwanted content
  • Reverse engineer, decompile or attempt to extract the source code of the Service (except to the extent permitted by applicable law)
  • Resell, sublicense or commercially exploit the Service or its content in a way that is not expressly permitted by us

We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms or engaged in conduct that harms the Service or other users.

5. Subscription, Fees and Payment

Some parts of the Service may be subject to fees as described on our website or within the application. By subscribing to a paid plan, you agree to pay all applicable fees in accordance with the pricing and billing terms in effect at the time of purchase.

Fees are generally charged in advance (e.g. monthly or annually). Unless otherwise stated, fees are non-refundable. We may change pricing upon reasonable notice; continued use of a paid plan after the effective date of a price change constitutes acceptance of the new price.

If you fail to pay fees when due, we may suspend or terminate your access to paid features after prior notice where required by law.

6. Your Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use and protect your personal data. By using the Service, you consent to the practices described in the Privacy Policy.

You retain ownership of the data you submit to the Service. We do not use your content for marketing or advertising purposes unrelated to the Service. We may use anonymised or aggregated data to improve the Service and for analytics, as described in the Privacy Policy.

7. Intellectual Property

The Service, including its design, software, text, graphics, logos and other materials (excluding content you upload), is owned by us or our licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute or create derivative works of the Service or its underlying technology except as expressly permitted (e.g. normal use of the application and export features).

"Logga" and our logo are our trademarks. You may not use them without our prior written permission.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free or secure. We are not responsible for the accuracy, completeness or suitability of any data you or other users enter, or for any decisions you make based on the Service (including operational, regulatory or airworthiness decisions). You use the Service at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE OR GOODWILL), WHETHER IN CONTRACT, TORT OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED EUROS (EUR 100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

10. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms or for other operational or legal reasons.

Upon termination, your right to use the Service ceases immediately. We may retain or delete your data in accordance with our Privacy Policy and applicable law. We encourage you to export your data before closing your account.

Sections that by their nature should survive termination (including Sections 7, 8, 9 and 11) will survive.

11. Governing Law and Disputes

These Terms are governed by the laws of Poland, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Poland, except where mandatory consumer protection laws in your country of residence require otherwise.

12. Changes to the Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. For material changes, we will take reasonable steps to inform you (e.g. by notice in the application or by email).

Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.
